Intellectual Property

Intellectual property is a broad category of property rights that generally refers to creations of the mind.  This includes, among other things, inventions, literary, motion picture, music and other artistic works, symbols, logos, names, photographs, and various industrial and fanciful designs whether used in commerce or otherwise.

The intellectual property “umbrella” includes trademarks, trade secrets, trade dress, patents, copyrights, unfair competition, and name and likeness rights.  As discussed elsewhere on this site, the three most common rights referred to under the intellectual property (IP) umbrella are patents, trademarks and copyrights.  Patents generally cover inventions, trademarks cover logos, slogans, and even sounds, and copyrights cover literary and artistic works such as novels, poems and plays, films, musical works, as well as artistic works such as drawings, paintings, photographs and sculptures, and architectural designs.
