This just in: YouTube has prevailed in motion for summary judgment, effectively fending off Viacom’s $1B claim for copyright infringement. Based on what I’m gleaning from news, the ruling appears to be largely founded on the protections inherent (for one who complies) in the Digital Copyright Millennium Act.
Here’s what Google has said in a statement it released: “This is an important victory not just for us, but also for the billions of people around the world who use the web to communicate and share experiences with each other. We’re excited about this decision and look forward to renewing our focus on supporting the incredible variety of ideas and expression that billions of people post and watch on YouTube every day around the world.”
So there you have it: they’re not just happy for themselves, they’re happy for you, me and the entire world. Yes, the rainbow shines over all Googleland, and the love it spreads is all encompassing, at least when seen through those Google-y eyes.
In the Valley of Viacom, however, things are not quite so bright, and its inhabitants not quite so jubilant. In a statement of its own, Viacom has said that it finds the court’s ruling “fundamentally flawed and contrary to the language of the Digital Millennium Copyright Act, the intent of Congress, and the views of the Supreme Court as expressed in its most recent decisions.” Yep, not much love happening there today. Viacom has said that it intends “to have these issues before the U.S. Court of Appeals for the Second Circuit as soon as possible.”
Who knows which way this will go? Not even Hobo Kelly (in an old clip you’d be sure to find on YouTube) could see that in her magic glasses. It is a certainty, however, that no matter what the Second Circuit says, someone will seek a review by the Supremes.
